Enforcing Your Child Support Order in New Jersey
In order to legally enforce court-ordered child support payments, you will need to file a New Jersey child support enforcement application with the Superior Court of New Jersey. You may file in the county in which the child resides or the county in which the parent who is ordered to pay child support resides. New Jersey also maintains records of the amount of child support due and paid through a computer database. When a parent fails to fulfill his or her child support obligation, they are considered to be “in arrears.”
The Probation Child Support Enforcement (PCSE) Unit monitors and enforces support orders. Members of this unit often act decisively when a parent is defaulting on the child support payments that he or she owes. In certain situations, the consequences can be as severe as arrest and incarceration. The court can also enforce a child support order through any of the following measures:
- Taking money directly out of the defaulting parent’s wages (called income withholding)
- Redirecting a tax refund
- Credit reporting
- Seizing his or her property
- Suspending his or her driver’s license
- Denying him or her a passport
- Taking money from a civil award or settlement, or from lottery winnings
